This license pertains to images created by Ellis Creek Photograpahy for use in selling residential real estate

COPYRIGHT: Ellis Creek LLC maintains full copyright ownership of all images.

USAGE: The images may be used by you (and your firm/ broker) to promote the sale of this property in any media. Your license to use these photos expires after the sale of the property or the termination of your current listing agreement. Your firm may continue to use the images as digital collateral for use in social media with attribution to Ellis Creek Photography. NO other use of the images (Printed art, gifts to clients, use by others, etc.) is permitted without further licensing.

CREATION: The manner and method of creating any Photographs is solely at the discretion of Photographer and the Client has no right to control Photographer’s manner and method of performance under this Agreement. Photographer will use his/her best efforts to: (a) ensure that the Photos conform to Client’s specifications; and (b) submit all Photos to Client in publishable quality, on or before the applicable deadlines.

DELIVERY: Images will be delivered via the Capture photo delivery service (www.mycapturephotos.com) in JPG format. Video files, Matterport and other digital products will be delivered using digital file-sharing services.

ATTRIBUTION: Ellis Creek Photography must be credited in any applicable publication of the images (ie. social media, online and print publications, etc.)

ALTERING IMAGES: Images may not be altered except for cropping and the addition of text. Further editing, retouching etc. is not permitted. Please contact us with any alteration requests.

MATTERPORT: Matterport and other 3D tour products will be active for the life of the listing or 1 full calendar year. After this time, the scan will be removed and the link will become inactive. Additional use of the Matterport tour will require a new license and additional fees.

SHARING: DO NOT share the photos outside your organization. ALL THIRD PARTY REQUESTS (including clients, contractors, vendors, designers, staging companies, other firms and editorial use) to use the images require advance authorization from Ellis Creek LLC. SHARING WITH OTHER AGENTS: These images are licensed to you. Other agents wanting to use the photos for social media etc. must get prior approval from Ellis Creek LLC. Such use is NOT an example of MLS Aggregate usage or broker reciprocity.

CO-LISTING: This license extends to other agents within your local office (within your firm) named as co-listing agents. This license does not extend to other firms and their agents. If co-listing with another firm, each firm (if using the images) must purchase a license to use the images for the promotion of the property.

MULTI-FAMILY APARTMENTS/ CONDOS: Our pricing is based on a single license for the one-time sale/rental of a single listing/unit. All photography for the rental or sale of multiple units requires a custom quote and license for such use. Please indicate your needs in your order notes.

TRAVEL: An extra 'Travel Charge' may be required for shoots outside of the Charleston area. For more information please contact us at info@elliscreekphotography.com

CANCELLATION: As we have to mobilize and commit resources for our projects in advance, we require 1 full business day and not less than 24 hours notice of cancellation or postponement of a photoshoot. The fee for such cancellation is up to 50% of the cancelled invoice items and not less than $100. EXCEPTION: we try to reschedule for weather 1 day before the shoot when possible. However we will sometimes make the decision with less than 24 hours before our scheduled photoshoot. We will waive the cancellation fee for weather related cancellation/postponement provided we are in a good faith dialogue about weather/scheduling in advance. Just let us know if you are concerned about the weather. We’re glad to work with you.

REFUNDS: Refunds for cancelled appointments will be refunded at the full paid amount minus any credit card fees not refunded to Ellis Creek LLC by the credit card servicer- typically 2-3%.

FEES: All fees are payable irrespective of whether Client makes actual use of the Photos. If you choose to pay a deposit only, we will process the balance of your fee on the day of the shoot. PAYMENT IS REQUIRED TO SCHEDULE YOUR PHOTO SHOOT. We will only add your photo shoot to our calendar when a minimum of 50% of your total fee is processed.

CREDIT CARD TERMS AND CONDITIONS: Thank you for storing your payment method. By providing this information you certify that you are the card owner or have authorization to process payments on this card. Additionally, you authorize Ellis Creek Photography to charge your card for the rendered services.
